【第2篇】市地稅稽查局涉外企業專項檢查年度工作總結

市地稅稽查局涉外企業專項檢查年度工作總結 根據市局部署安排,市地稅稽查局4至6月份組織檢查人員對15戶涉外企業2003年至2022年地方各稅費繳納情況開展了專項檢查,根據企業實際情況採取調帳檢查和實地檢查相結合的方式,認真詳細地檢查了企業的賬簿、憑證、報表及有關資料。目前15戶企業已檢查完畢,共查補稅(費)21.89萬元,加處罰款5.42萬元,加收滯納金1.25萬元,合計28.56萬元(有4戶尚在審理之中)。 一、 主要工作做法 (一) 查前吃透稅收政策4月上旬,國際稅務管理科就有關涉外稅收政策,召集檢查人員進行了查前輔導,並提出了嚴格的要求,通過學習,檢查人員吃透了涉外企業的稅收政策,做到了有的放矢。 (二) 查中宣傳稅收政策 由於涉外企業大多成立時很短,加上一部分財務人員素質不高,對稅收政策掌握和理解不深,應在日常申報的稅而未申報。檢查人員問其原因,回答說是不知道要交某種稅,或是說沒人告訴要交某種稅,甚至對要繳的稅產生疑惑。究其原因是對稅法知識不夠了解。檢查人員根據這種情況,不失時機的向納稅人宣傳稅收政策,耐心解釋徵稅的依據和規定。很多納稅人感慨到,通過這次檢查,學到了不少稅收知識,避免了今後不出現或少出現類似的問題。 (三) 查後及時溝通和交流 大多數涉外企業,被查出的稅款,並非主觀故意偷逃稅款,而是上面所說的,對稅收知識不清楚不懂所致,他們對查出的稅款不想因補稅而罰款。很多外商主觀意識上不想偷稅,更不想在稅收上而受到處罰,一旦受到處罰他們會責怪財務人員的。所以每查結一戶,檢查人員都要與企業的負責人和財務人員進行座談,一是講解稅法的規定,取得理解,二是給企業提出加強和改進財務管理的建議。通過交流溝通,企業感受到稅務人員的嚴格執法和真誠服務,不但按規定補交了稅款和罰款,而且稱讚地稅良好的作風形象。 二、發現主要問題: (一)印花稅申報不足 在對涉外企業地方各稅進行檢查時,發現涉外企業在增值稅等大的稅種繳納方面還是足額的,但在地方小稅種繳納方面,尤其是印花稅繳納普遍不夠足額,大部分納稅人僅對銷售收入這部分分月(季)按購銷合同覈定申報繳納,但在企業經濟交往中, 經常與對方簽訂的加工承攬、建築工程、勘察設計、財產租賃、財產保險、貨物運輸、技術服務、借款合同、產權轉移等一些合同或協議,大多數企業財務人員對這些合同或協議不知道要繳納印花稅,有的企業在收到實收資本和增加的資本公積也沒有繳納資金帳簿印花稅,他們在被查時都感到很冤枉。有一戶企業在被查補的印花稅中,僅上述列舉的合同協議中就有六項未申報,加上資金帳簿印花稅,共查補補繳了近2.8萬元的印花稅。 (二)個人所得稅代扣代繳不足 一是少數企業對個人所得稅扣繳認識不足,認爲全年平均每月達不到標準就不扣;二是大多數企業對工資以外的收入部分在計算個人所得稅時不計入,如用現金髮放的防暑降溫費、值班補助費、加班費等,顯然造成代扣不足;三是少數財務人員對個人所得稅政策理解不透,造成少代扣;四是個別企業沒有把擔任董事職務並且取得年薪的外籍個人在外國取的收入合併計徵個人所得稅;五是個別企業代職工繳納的應由個人支付的保險,未計入工資薪金所得代扣個人所得稅;如某公司2022年在管理費中支付職工儲金保險32萬元,造成少扣繳個人所得稅3.2萬元。 (三)城市房地產稅申報繳納有不足現象。城市房地產稅是由於企業計稅依據弄錯或疏忽漏報;加上責任人未及時宣傳輔導造成少繳納。(四)個別企業對資源稅應稅礦產品。例如:黃砂、石子等不能足額代扣代繳。(五)水利基金繳納仍重視不夠。我們在檢查的15戶企業中有12戶存在補繳水利基金,尤其是職工個人水利基金繳納不足,如某公司兩年補繳職工個人水利基金4000多元。(六)發票問題。少數企業在取得對方的發票時,不能對稅收政策和發票管理規定掌握得很清楚,不能嚴格把關發票,出現收到不符合規定的發票入帳,如某企業進行工程發包,應取得建安發票,卻收到國稅普票和外地建安發票,容易造成對方偷逃稅款。三、幾點建議(一)加強對涉外企業的稅法宣傳和輔導尤爲重要,企業對地稅部門徵收的一些地方稅種不是主觀故意不繳,而是對稅法知識缺乏瞭解所致,徵管責任人要常到企業走走,及時把稅收政策、容易出現的問題告知納稅人。(二)要注重對涉外企業個人工資以外發放的現金和實物的檢查,瞭解企業是否將工資以外的發放給個人收入部分予以扣繳個人所得稅;對擔任董事職務並且在本企業取得工資或年薪的外籍個人同時又有來自外國任職公司的收入部分,要督促其提供在國外取得的收入和已扣繳個人所得稅的資料,以便與國內收入合併計徵個人所得稅。(三)在印花稅徵管工作中,由於大多數納稅人對印花稅的概念還是不清楚,有的容易忽視,有的認爲只要是對方交了,自己就不用交的錯誤想法,所以應加強對涉外企業印花稅的宣傳和管理,每次申報時要經常提醒和督促。因爲涉外企業的外籍老闆大多是講究納稅信譽度的,他們不想因不懂稅法而受到不應有的處罰。(四)要重視城市房地產稅和資源稅,督促企業按時足額申報繳納。(五)要加強企業取得發票的審覈,督促財務嚴格把關,從源頭控管,加大處罰力度,防止錯用發票的現象。
